Terms And Conditions When Booking JMF Disco - The Party Mobile Disco.

All bookings with JMF Disco are confirmed in writing, as you would expect from a professional company, using the following Contract Conditions setting out the rights and responsibilities of both parties. These Conditions will be altered to suit the nature of any particular type of event - any such alterations will be included on the Booking Form for you to sign agreeing to those conditions before the booking is confirmed. If you do not understand or need any of the conditions explaining please contact me to discuss - they are used to protect us both!

There are various payment options available and we can be flexible to suit any 'corporate payment systems' that you have to work with

CONFIRMATION OF BOOKING AND DJ PERFORMANCE CONTRACT

This AGREEMENT is made effective this xxxxxxxx day of xxxxxx 20xx by and between xxxxxxxxx, located at xxxxxxxxxxxxxx, xxxxxxxxxxxxxx, xxxx xxxxxxx (hereinafter referred to as the "Purchaser") and John Padmore - JMF Disco, 54 Beaconsfield Road, Sittingbourne, Kent ME10 3BB (hereinafter referred to as the "Entertainer").

In consideration of the terms and conditions as specified in this agreement, the Purchaser and the Entertainer agree as follows:

The place of performance is located at xxxxxxxxxxxxxxxxxxxxxx, xxxxxxxxxxxxxxxxxx, xxx xxxxxx, xxxxxxxxxxxxxxx, xxxxxx xxxxxxx (hereinafter referred to as the "Venue").

The date of the Performance shall be xxxxxxxxxxxxxx and the time of the Performance shall be from xxxxxxx. This Performance shall have a duration of xx hours, finishing at xxxxxx

Purchaser agrees to pay the Entertainer a fee of xxx xxxxxxx pounds (£xxx.xx) for the Performance. A non returnable booking fee in the amount of £xxx is due upon execution of this contract in cash or by cheque (cheques should be made payable to J S Padmore). The remaining payment must be made in full prior to performance in cash at beginning of event or by cheque (presented minimum 7 days prior to performance). In the event of non-payment prior to the performance, the Purchaser agrees this Agreement shall be cancelled immediately with no performance required and any previous payments shall be immediately forfeited to the Entertainer. In the event of non-payment after the performance, Purchaser further agrees to remit any uncollected balance including a £5 per statement fee plus reasonable collection or solicitors fees. Purchaser shall be charged £20 for each returned cheque plus a £5 service charge for each collection notice. Past-due balances will incur interest at the rate of 2% for each month in which the balance is outstanding.

If the DJ is required to play on past the agreed finishing time, the fee for such extended performance is £20 per 30 minutes or part thereof, payable in cash, at the time of requesting extra time. The extended performance is subject to the rules of the Venue, and is at the Entertainer's discretion.

The entertainment to be provided by the Entertainer is described as the playback of musical recordings through sound equipment with occasional "DJ" narration and provision of disco lighting (hereinafter referred to as the "Performance").

The Purchaser reserves the right to control the manner, means and details of the performance of services by Entertainer via a written Event Information Sheet or music request list prior to the event. Without an Event Information Sheet or music request list, Entertainer shall attempt to play Purchaser's and Purchaser's guests' music requests but shall not be held responsible if certain selections are unavailable. The Entertainer reserves the right to censor music requests that may be considered offensive or inappropriate for the event. Entertainer reserves the right to choose the sequence of songs played for the good of the majority and the flow of the event.

The Entertainer and his assistant(s) will undertake to conduct themselves in a correct and proper manner at all times and will respond to the Purchaser's or Venue's requests as to volume, situation of equipment and any other reasonable requests providing they do not breach any health and safety regulations.

This agreement to perform shall be excused by detention of personnel by sickness, accidents, riots, strikes, epidemics, acts of God, or any other legitimate condition beyond the Entertainer's control. If such circumstances arise, all reasonable efforts will be made to find comparable replacement entertainment at the agreed upon fees. Should Entertainer be unable to procure a suitable replacement, Purchaser shall receive a credit or full refund of all prepaid fees.
Purchaser agrees that in all such circumstances, Entertainer's liability shall be exclusively limited to refunding the fees paid and Entertainer shall not be liable for indirect or consequential damages arising from any breach of contract.

Purchaser agrees to provide a secure parking space in a reasonably close proximity to Venue's loading area for Entertainer's vehicles for a period commencing two (2) hours prior to the performance and continuing for one (1) hour following the performance, at no charge.

If the Purchaser or Venue has any special requirements for setting up or dismantling times or there are specified times of access, the Purchaser must of provided these details prior to the booking. Any unnotified restrictions may attract additional charges and/or cause delay to the performance.

Purchaser and/or Venue shall provide adequate security for the Entertainer and their property before, during and after the Performance. Any damage or theft to the Entertainers property, including transportation, will be paid for by the Purchaser. Any threats, either physical or verbal, will not be tolerated by the Entertainer and the Entertainer reserves the right to end the performance at any time if he feels threatened in any way and the whole fee will remain payable.

The Entertainer will not be held responsible for any actions, behaviour or damage caused by those attending the event, under any circumstances.

The Purchaser and/or Venue warrants that he/she in entitled to use the venue for the purposes of the event and performance. The Entertainer shall in no way be held responsible for any breaches of covenants, regulations, bye-laws, conditions and such like relating to the use of the venue.

In the event of failure of a non structured building or marquee to provide adequate protection, the Entertainer reserves the right not to perform or end the performance in the interest of health and safety and the whole fee will remain payable.

Sound and Lighting. The Entertainer shall furnish all sound equipment, microphones, lighting and power strips necessary for the Performance. Purchaser agrees to provide access to at least two three-prong grounded 230 Volt/13 AMP wall plugs. The Entertainer agrees to provide all personnel required to assist the setup for and conduct of the Performance and takedown after the Performance.

This agreement cannot be cancelled except by mutual written consent of both the Purchaser and Entertainer. In the event of you or the venue wishing to cancel the performance for any reason other than Act of God or National Disaster a cancellation fee of not less than one half of the agreed fee will become due. If the cancellation is within thirty days of the performance the whole of the agreed fee will become due.

Purchaser agrees to defend, indemnify, assume liability for and hold Entertainer harmless from any and all claims, demands, damages, losses, suits, proceedings, penalties, expenses or other liabilities including solicitor fees and court costs, arising out of or resulting from the performance of this contract, regardless of the basis (except for gross negligence on the part of Entertainer).

Purchaser may not transfer this contract to another party without the prior written consent and approval of Entertainer.

Both Purchaser and Entertainer are legally able and have full legal capacity to execute this Agreement on the day and year first above written.
